Abstract
Pada skripsi ini, penulis mengangkat permasalahan penerapan prinsip hak untuk menentukan nasib sendiri melalui referendum yang terjadi di Catalonia, Spanyol. Latar belakang pemilihan judul oleh penulis karena penerapan dari prinsip ini cenderung tidak sesuai dengan norma-norma yang terdapat di dalam Hukum Internasional. Hal tersebut dilatar belakangi oleh salah satu penyebabnya yaitu tidak terdapat nya peraturan yang mengatur secara terperinci tentang penerapan hak tersebut, sehingga dalam penerapan prinsip tersebut akan menimbulkan konflik-konflik yang tidak diinginkan. Berdasarkan hal tesebut, sehingga skripsi ini mengangkat rumusan masalah sebagai berikut : (1) Apakah penerapan prinsip Right to Self-Determination Catalonia di Spanyol dapat dibenarkan berdasarkan Hukum Internasional. (2) Bagaimana status negara Catalonia apabila tidak diakui oleh negara Spanyol sebagai negara induk dan negara lainnya. Selanjutnya dalam penulisan skripsi ini, menggunakan metode yuridis normatif dengan pendekatan peraturan hukum tertulis (statute approach), pendekatan kasus (case approach). Bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier penulis analisis menggunakan metode deskriptif analitis yaitu, dengan cara menganalisa inti dari konvensi-konvensi internasional maupun pendapat dari para sarjana hukum internasional. Dengan demikian, hasil dari penelitian penulis menemukan bahwa jawaban atas kedua rumusan masalah adalah, penerapan prinsip hak untuk menentukan nasib sendiri tidak dapat diterapkan kepada Catalonia, karena Catalonia bukanlah negara terjajah ataupun negara tanpa pemerintahan sendiri. Selain itu tidak adanya pengakuan yang diberikan terhadap Catalonia membuat status negara nya dari referendum kemerdekaannya pun gugur.
English Abstract
In this paper, author raised the questions about application of right to self-determination through a referendum which happen at Catalonia, Spain. The author background choose the title is because the application of this principle tend againts the norms under International Law. It is backed by one of the cause, that was there are no rules which regulates in detail about the implementation of these rights, so in the application of these principles will lead to undesireable conflicts. Based on those matters, this thesis raises the following issues: (1) Whether the application of the principle of Right to Self-Determination Catalonia in Spain can be justified under international law. (2) How the status of the state of Catalonia if not recognized by the Spanish as the parent state and other countries Furhermore, in writing this thesis , using normative juridical method with the approach of statutory law (statute approach), and case approach (case approach). The primary legal materials, secondary legal materials and tertiary legal materials of analytical writers use descriptive analytical methods that is, by analyzing the meaning of international conventions as well as the opinions of some international juris Thus, the results of the author research found that the answer to both formulation of the problem is, the application of right to self-determination can’t applied to Catalonia, because Catalonia is not a colonized country or a state without its own government.
