Abstract

Notaris sebagai sebuah jabatan memiliki kewenangan tersendiri yang diatur dengan aturan hukum dalam pembuatan akta otentik. Kewenangan tersebut dijelaskan pada Pasal 15 Undang-undang Nomor 2 Tahun 2014 tentang perubahan atas UUJN. Namun, kewenangan tersebut belum sempurna karena tidak adanya kewenangan Notaris untuk investigasi, sehingga notaris tidak mampu menyelidiki kebenaran materiil dari data dokumen dari penghadap benar atau tidak. Keadaan demikian seringkali menyeret Notaris kedalam permasalahan hukum baik ranah pidana maupun perdata. Berdasarkan hal tersebut, karya tulis ini mengangkat rumusan masalah, yaitu: Bagaimana pertanggung jawaban notaris atas kebenaran substansi akta otentik, baik berdasarkan Undang-undang nomor 2 Tahun 2014 dan kode etik notaris, secara perdata maupun secara pidana? Tujuan penulisan penelitian tesis ini dibagi menjadi dua, yaitu tujuan umum yang bersifat akademis dan tujuan khusus yaitu untuk mengkaji dan menganalisis bagaimana pertanggungjawaban notaris dalam membuat akta otentik serta untuk mengetahui dan memahami akibat hukum terhadap akta otentik yang dibuat oleh notaris ketika para pihak memberikan data palsu. Penelitian ini adalah penelitian yuridis normatif dengan menggunakan metode pendekatan Perundang-undangan (statute approach) dan pendekatan konseptual, Berdasarkan analisis terhadap bahan hukum yang diperoleh, pada dasarnya notaris memiliki tanggung jawab atas formalitas dari suatu akta otentik dan tidak memiliki tanggung jawab atas materi dari isi akta otentik itu kecuali pada relass akta. Notaris hanya dapat dimintakan pertanggungjawaban apabila Notaris terbukti melakukan pelanggaran administrasi, perdata dan pidana. Notaris harus bertanggung jawab dari segi Hukum Administrasi, Hukum Perdata, yaitu sesuai ketentuan sanksi yang tercantum dalam Pasal 84 dan 85 UU Perubahan atas UUJN dan kode etik, namun di dalam UUJN dan UU Perubahan atas UUJN tidak mengatur adanya sanksi pidana. Notaris tidak dapat dimintakan pertanggungjawaban pidana apabila muncul kerugian terhadap salah satu pihak sebagai akibat adanya dokumen palsu dari pihak lain,karena notaris hanya mencatat apa yag disampaikan oleh para pihak untuk dituangkan ke dalam akta. Keterangan palsu tersebut menjadi tanggung jawab para pihak, bukan tanggung jawab notaris, kecuali penipuan atau tipu muslihat itu bersumber dari Notaris itu sendiri maka notaris dapat dimintakan pertanggungjawaban pidana sesuai dengan pasal 263, 264, 266 KUHP.

English Abstract

Notary as a position has its own authority which is regulated with the rule of law to make an authentic deed. This authority is described in Article 15 of Law Number 2 Year 2014 as amendments from UUJN. However, this authority is unperfect due to not arranged authority to Notary's for investigation, so the notary is unable to investigate the thruth of material document data fom confrontist is true or not. Condition like that often drag the Notary into legal issues in both criminal and civil problems. Based on the problem background, this paper raises formulation of the problem: How is liability of a notary about the truth of the substance of authentic deed, based on Article of Law number 2 Year 2014 and code ethics of Notary in civil law and criminal? The purpose of this thesis research is divided into two, that is general purpose of an academic and special purpose is to examine and analyze how the notary accountability in making authentic deeds and to know and understand the legal consequences of authentic deeds made by the notary when the parties provide false data. This thesis is a normative research with using statute approach and conseptual approach. Based on the analysis of legal material obtained, basically a notary has responsibility for the formalities of an authentic deed and has no responsibility for the material of the contents the authentic deed except in the relass deed. Notaries can be requested of accountability if the Notary is proven to have committed administrative, civil and criminal violations. Notary must be responsible in terms of Administrative Law, Civil Law, that is in accordance with the provisions of sanctions contained in Article 84 and 85 on Amendment of UUJN and code of ethics, but in UUJN and UUJN Change Law does not regulate the existence of criminal sanctions. Notary cant be sought for criminal liability if there is a loss to one of the parties as a result of false documents from another party, since the notary only records what the parties have submitted to the deed. Such false statements shall be the responsibility of the parties, not the responsibility of the notary, unless such fraud or deceit originates from the Notary itself, a notary may be sought for criminal responsibility in accordance with article 263, 264, 266 of the Criminal Code.
