Indonesian Abstract

Dengan diundangkannya Undang-Undang Nomor 4 Tahun 1996 tentang “Hak Tanggungan atas tanah beserta benda-benda yang berkaitan dengan tanah”, maka lembaga jaminan Hak Tanggungan dapat memberikan suatu kepastian hukum tentang pengikatan jaminan dengan tanah dan benda-benda yang berkaitan dengan tanah sebagai jaminan dalam Lembaga Perbankan. Bilamana terjadi kredit macet maka Lembaga Jaminan Hak Tanggungan diharapkan mampu memberikan solusi penyelesaian kredit macet bagi Lembaga Perbankan. Dalam menghadapi debitor yang wanprestasi/ingkar janji sehingga menimbulkan kredit macet, Bank dapat melakukan upaya penyelesaian kredit macet dengan menggunakan Lembaga Jaminan Hak Tanggungan atas tanah, dengan melaksanakan eksekusi terhadap jaminan yang telah dibebani Hak Tanggungan. Rumusan Masalah dalam penelitian ini adalah: Bagaimana pelaksanaan eksekusi Hak Tanggungan berdasarkan UU Nomor 4 Tahun 1996 dan Apa kendala yang menjadi penghambat dalam pelaksanaan eksekusi. Dari analisa diperoleh hasil bahwa dalam praktek Lembaga Perbankan, untuk Bank Perkreditan Rakyat (BPR) juga memberikan kredit kepada para nasabah dengan jaminan berupa tanah dan/atau bangunan yang diikat dengan Hak Tanggungan. Kredit kepada para nasabah dengan jaminan berupa tanah dan/atau bangunan yang diikat dengan Hak Tanggungan juga dilaksanakan di BPR Puridana Arthamas di Sidoarjo dan BPR Armindo Kencana di Malang. Bahwa pada BPR juga terjadi beberapa debitor melakukan wanprestasi sehingga mengakibatkan kualitas kredit atau Kualitas Aktiva Produktif menjadi kredit macet. Dengan adanya kredit macet tersebut pihak BPR mengupayakan pengembalian atas kredit yang telah disalurkan dengan cara melaksanakan eksekusi Hak Tanggungan terhadap obyek jaminan yang telah diikat dan dibebani Hak Tanggungan. Dari penelitian ini diperoleh kesimpulan cara pelaksanaan eksekusi adalah dengan cara Menjual Obyek Hak Tanggungan secara Di Bawah Tangan, eksekusi berdasarkan Parate Eksekusi dan eksekusi berdasarkan Titel Eksekutorial. Kendala yang menjadi penghambat dalam pelaksanaan eksekusi obyek Hak Tanggungan adalah timbulnya beberapa permasalahan hukum tertentu, yaitu adanya sita, sengketa atau gugatan hukum.

English Abstract

The enactment of Law number 4 of 1996 on Mortgage (Hak Tanggungan) of land and other things involved upon land, this security institution of mortgage gives a law certainty on a land with other things that involved upon land which becomes collateral at Banking institution. In case of there is appears non performing loan this mortgage is going to give a solution for Banking institution. In order to face the debtor who breaches the loan agreement or credit agreement, which debtor defaults to payback the loan and finaly the status of this loan or this credit becomes non performing loan, if this condition happen Banking institution can use or secure their loan that have been launched by using the security institution of mortgage to get back or to secure that loan by doing execution of mortgage over collateral which have been binded by Mortgage (Hak Tanggungan). Problems formulation of this research are: How is the execution on Mortgage base on Law number 4 of 1996, and What are the constrains which can hamper the execution. From this research, the result of the analysis shows which in practice of Banking institution such as People Credit Bank (Bank Perkreditan Rakyat/BPR) also launches its credit facilities to his customers cover by land and/or building as collateral. The way to secure the loan, BPR directly binds its collateral by Mortgage (Hak Tanggungan), these activities also done by BPR Puridana Arthamas at Sidoarjo and BPR Armindo Kencana at Malang. In these BPR frequently happen, such customers or debtors have breached the loan agreement so therefore the status of the loan or quality of loan becomes non performing loan or bad debt. In order to find the solution or to get back the loan from this bad debt, BPR is going to use Mortgage institution by doing execution of Mortgage over collateral that have been binded by Mortgage (Hak Tanggungan). The conclusion of this research is the ways to execute the Mortgage institution, as follows: sale the object of mortgage under the hand, execution based on Parate Executie, and execution based on executorial title. The constrains which could hamper the execution of Mortgage are the emerge of particular law problem, such as there are confiscation (sita), law dispute, or a lawsuit when BPR will execute the Mortgage.
