Indonesian Abstract

Penelitian ini bertujuan untuk Untuk mengetahui dan menganalisis Implementasi Pasal 17 Peraturan Daerah Kota Malang Nomor 2 Tahun 2014 dalam pemenuhan hak pendidikan bagi penyandang disabilitas di Kota Malang dan mengidentifikasi kendala yang mempengaruhi serta solusi untuk mengatasi hal tersebut. Penelitian ini menggunakan metode Yuridis Empiris dan dianalisis dengan teori implementasi kebijakan Van Meter Van Horn. Hasil penelitian menunjukan Implementasi Pasal 17 Peraturan Daerah Kota Malang Nomor 2 Tahun 2014 dalam pemenuhan hak pendidikan bagi penyandang disabilitas di Kota Malang sudah berjalan dengan cukup baik apabila dikaji dari variabel ukuran dasar kebijakan, sumber-sumber kebijakan, komunikasi antar organisasi, karakteristik agen pelaksana, disposisi atau kecenderungan implementator dan kondisi lingkungan sosial, politik dan ekonomi serta pemenuhan hak pendidikan bagi penyandang disabilitas telah terpenuhi dan memiliki hak yang sama dalam mengenyam pendidikan . Kendala yang mempengaruhi terdiri dari faktor internal seperti terlalu sedikitnya UPT di Kota Malang dan kurangnya koordinasi di tingkat RT/RW dan faktor eksternal seperti Kurangnya kesadaran keluarga penyandang disabilitas untuk mendaftarkan anggota kepada lembaga pendidikan khusus penyandang disabilitas, kondisi lingkungan sosial tempat penyandang disabilitas, rasa malu dari penyandang disabilitas. Sehingga diperlukan solusi seperti penambahan UPT, koordinasi yang terpadu hingga tingkat RT/RW dan sosialisasi mengenai hak penyandang disabilitas dalam memperoleh pendidikan.

English Abstract

This study aims to know and analyze the Implementation of Article 17 of Malang City Regulation No. 2 of 2014 in the fulfillment of the right to education for persons with disabilities in Malang and identify the constraints that affect and the solution to overcome it. This research uses Juridical Empirical method and analyzed by van vaner policy implementation theory Van Horn. The result of the research shows that Implementation of Article 17 of Malang City Regulation Number 2 Year 2014 in fulfilling the right of education for persons with disability in Malang City has been running well enough when examined from policy base size variables, policy sources, inter-organizational communication, the disposition or tendency of the implementer and the social, political and economic environment as well as the fulfillment of the right to education for persons with disabilities have been fulfilled and have equal rights in education, the same rights include the admission process of school admission without or with special qualifications, special skills training in accordance with their abilities and report on discriminatory acts against him especially in terms of obtaining education. The influencing constraints consist of internal factors such as too few UPTs in Malang and lack of coordination at the RT / RW level and external factors such as the lack of awareness of the families of persons with disabilities to register members to special education institutions with disabilities, the social environment conditions of persons with disabilities, of persons with disabilities. So it needs solution such as UPT addition, integrated coordination up to RT / RW level and socialization about the rights of people with disabilities in obtaining education.
