Abstract
Penelitian ini mengkaji tentang bagaimana relasi antar institusi dibangun dan dikelola oleh sebuah lembaga negara yang dalam hal ini adalah Bawaslu RI melalui pembentukan sebuah Jejaring Kelembagaan dalam penanganan pelanggaran netralitas Aparatur Sipil Negara (ASN) pada Pemilihan Umum Serentak Tahun 2019. Penelitian ini memiliki beberapa latar belakang permasalahan, yaitu masalah netralitas ASN ini menjadi salah satu dari tiga permasalahan utama dalam setiap momen Pemilu. di Pemilu 2019 banyak temuan dan laporan pelanggaran Pemilu tentang dugaan pelanggaran netralitas Aparatur Sipil Negara sebanyak 1.096 kasus. Permasalahan lainnya adalah Bawaslu RI bertanggung jawab mengawasi netralitas ASN, tetapi terhambat oleh keterbatasan kewenangan di mana Bawaslu tidak bisa menindak ASN, hanya sebatas memberikan rekomendasi. Penelitian ini menggunakan teori Network Governance yang dikemukakan oleh Klijn, Koppenjan, & Termeer. Teori ini diterapkan melalui dua langkah strategi yang masing-masing memiliki tiga indikator di dalamnya. Metode penelitian yang digunakan adalah penelitian deskriptif yang akan menghasilkan data kualitatif. Hasil dari penelitian ini menemukan bahwa dari enam indikator yang ada di dalam teori Network Governance, pada Jejaring Kelembagaan Bawaslu RI hanya menerapkan lima dari enam indikator. Indikator lainnya tidak diterapkan karena suatu alasan tertentu. Melalui Strategi Game Management dan Network Structuring yang ada di dalam teori Network Governance ini, Jejaring Kelembagaan ini menghasilkan dua output yaitu Nota Kesepahaman dan Perjanjian Kerja Sama yang mengatur dan mengikat antar dua institusi yaitu Bawaslu RI dan Komisi Aparatur Sipil Negara.
English Abstract
This research ecamines how relations between institutions are build and managed by a state institution which in this case is the Electoral Supervisory Body of the Republic of Indonesia through the establishment of an Institutional Network in handling neutrality violations of the State Civil Apparatus (SCA) at the Concurrent General Election in 2019. This research has several background issues, i.e the SCA neutrality issue is one of the three main problems in each election moment. In the 2019 elections there are many findings and reports of the election violations regarding the alleged violation of the neutrality of the State Civil Apparatus in 1.096 cases. Then, another problem is that the Electoral Supervisory Body has an responsible for overseeing the neutrality of SCA, but there is hampered by limited authority which is the Electoral Supervisory Body cannot give punishment on SCA, they just allowed to providing recommendations. This study uses the Network Governance Theory by Klijn, Koppenjan, & Termeer. This theory is applied through a two-step strategy, each of which has three indicators in itu. The research method used is a descriptive research that will produce qualitative data. The results of this study found that of the six indicators contained in Network Governance Theory, the Institutional Network of the Elecoral Supervisory Body only applied five of the six indicators of Theory. The other indicators are not applied for some reason. Throught the Game Management and Network Structuring Strategy that is contained in this Network Governance Theory, this Institutional Network produces two outputs, i.e Memorandum of Understanding and the Cooperation Agreement that governs and binds between the two institution namely Electoral Supervisory Body and The State Civil Apparatus Commission.
