Indonesian Abstract

Pengaturan mekanisme pengisian anggota Badan Permusyawaratan Desa dalam ketentuan Pasal 56 Ayat (1) Undang-Undang Desa menjelaskan bahwa anggotawBadan PermusyawaratanwDesa merupakanwwakil dariwpenduduk desa berdasarkanwiketerwakilan wilayahwiyang pengisiannyawidilakukan secara demokratis. Yangadimaksudadengan “dilakukan secara demokratis” yaitu dapat diproses melalui proses pemilihan langsungwatauwmelalui proseswmusyawarah perwakilan. Frasa “dapat” menimbulkan implikasi hukum yaitu mekanisme pengisian anggota BPD bisa melalui proses pemilihan secara langsung atau melalui musyawarah perwakilan. Sehingga hal ini menimbulkan persoalan dalam masyarakat. Seperti yang terjadi di Kabupaten Bekasi, yakni terjadi perbedaan pendapat antara Pemerintah Kabupaten Bekasi dengan masyarakat Desa Cipayung. Berdasarkan latar belakang masalah tersebut muncul tiga rumusan masalah, yaitu pertama, mengapa politik hukum pengaturan mekanisme pengisian anggota Badan Permusyawaratan Desadapat dilaksanakan melalui proses pemilihan langsung atau musyawarah perwakilan. Kedua, bagaimanakah implikasi hukum dari pengaturan tentang mekanisme pengisian anggota Badan Permusyawaratan Desa baik melalui proses pemilihan langsung atau melalui proses musyawarah perwakilan. Ketiga, bagaimanakah pengaturan mekanisme pengisian anggota Badan Permusyawaratan Desa yang sesuai dengan prinsip-prinsip negara hukum dan demokrasi. Dari rumusan masalah ini, maka jenis penelitian yang digunakan yaitu penelitian hukum normatif, dengan pendekatan perundang-undangan (statute approach) dan pendekatan historis (historical approach).Dengan menggunakan teknik analisis preskriptif. v Berdasarkan kajian analisis teori terhadap ketiga rumusan masalah di atas, maka didapat hasil analisis sebagai berikut: Pertama, Berdasarkan Risalah Pansus RUU tentang Desa, pengaturan mekanisme pengisian anggota BPD dapat dilaksanakan melalui proses pemilihan secara langsung atau melalui proses musyawarah perwakilan karena sebagai penghormatan dan pengakuan atas keragaman (kebhinekaan) bentuk dan susunan pemerintahan desa-desa di Indonesia. Dalam hal ini pemerintah Kabupaten/Kota yang lebih memahami kondisi masing-masing desa, sehingga ketentuan selanjutnya mengenai mekanisme pengisian anggota BPD diatur dalam Peraturan Daerah. Kedua, implikasi hukum dari pengaturan mekanisme pengisian anggota BPD dalam ketentuan Pasal 56 Ayat (1) yaitu frasa “dapat” berarti memberikan dua pilihan yaitu dapat melalui proses pemilihan secara langsung atau musyawarah perwakilan. Akan tetapi, dalam beberapa Peraturan Daerah belum menentukan menggunakan pemilihan langsung atau musyawarah perwakilan. Sehinggamenimbulkan perbedaan keinginan antara masyarakat dengan pemerintah mengenai mekanisme pengisian anggota BPD. Dalam hal ini, masyarakat menginginkan pemilihan secara langsung sedangkan pemerintah menginginkan melalui musyawarah perwakilan. Ketiga, Pengaturan mekanisme pengisian anggota Badan Permusyawaratan Desa dalam Pasal 56 Ayat (1) Undang-Undang Nomor 6 Tahun 2014 tentang Desa yaitu dilakukan secara demokratis, dalam artian dapat diproses melalui proses pemilihan langsung atau melalui proses musyawarah perwakilan. Akan tetapi, setelah implikasi dari kedua proses pengisian anggota BPD dianalisis dalam bab pembahasan, maka pengaturan mekanisme pengisian anggota BPD yang sesuai dengan prinsip negara hukum dan demokrasi yaitu melalui proses pemilihan langsung oleh masyarakat desa setempat yang mempunyai hak pilih.

English Abstract

The regulation in terms of the election of members of Village Representatives Council in Article 56 Paragraph (1) of Act on Village states that Village Representatives Council consists of the members elected as representatives of the village based on areas and it is performed democratically. The term ‘performed democratically’ emphasises that the election process cannot be represented or it is performed based on representatives session. The phrase ‘can’ brings legal implication, where the election of the members can be performed directly (cannot be represented) or based on representatives session. This condition causes an issue in society. Different opinions between the government of the regency of Bekasi and local people in Cipayung village of the Regency of Bekasi is seen as an example of the issue. The issue above has led to the three following research problems: 1) why is the legal politics of regulating the mechanism for electing the members of the Village Representatives Council performed based on direct election or representatives session? 2) What is the legal implication of the regulation regarding the mechanism for the election based on either direct election or representatives session? 3) How is the mechanism regulated based on the principles of the state of law and democracy? Following the problems, this study employed statute and historical approaches, supported by prescriptive analysis. Referring to the theoretical analysis of the three research problems, this study concludes that according to the minutes of tailor-made committee according to the bill concerning Village, the regulation of the mechanism should be performed through direct election and representatives session as this mechanism is aimed to respect and recognise the diversity of forms and village government structures in Indonesia. Furthermore, since the local governments are more familiar to the condition of each village, the provisions regarding the mechanism of election of the members of the village representatives are regulated in Local Regulation. In terms of the legal implication, the word ‘can’ in the provision of Article 56 Paragraph (1) implies two to choose from, comprising direct election and session. However, the Local Regulation has not involved any of those two, sparking different intentions over how the election must be conducted between the government and its people, where people prefer direct election while the government tends to refer to the other way of election. The regulation of the mechanism for the election of the members for Village Representatives Council in Article 56 Paragraph (1) of Act Number 6 of 2014 concerning Village implies that the election must be conducted democratically, meaning that the election can be done either in direct election or in representatives session. Following the analysis of the implication of the two processes required in the election, the discussion of this study concludes that the mechanism for the regulation of the election of the members for the village representatives should be based on direct election where the locals in a village have their rights to vote for members of representatives. This way is deemed to meet the principles of the state of law and democracy.
