Indonesian Abstract

Penulis membahas terkait Pelakasanaan Prinsip Kehati-Hatian melalui aplikasi SIDAK (Sistem Informasi Data Analisis Karakter) Debitur di PT. BPR Delta Artha Kencana. Aplikasi SIDAK Debitur merupakan aplikasi yang melakukan analisis karakter calon debitur untuk menentukan apakah calon debitur tersebut layak menjadi debitur. Aplikasi SIDAK Debitur dapat menjadi solusi terhadap terjadinya kredit macet. Namun dalam pelaksanaan aplikasi SIDAK Debitur, masih ditemui beberapa hambatan dari segi yuridis maupun non yuridis. Berdasarkan permasalahan tersebut, diajukan dua rumusan masalah: (1) Bagaimana pelaksanaan prinsip kehati-hatian melalui aplikasi “SIDAK Debitur” dalam upaya mencegah resiko kredit macet di PT. BPR Delta Artha Kencana di Kecamatan Pakisaji, Kabupaten Malang? (2) Apa saja hambatan yuridis dan non yuridis, serta upaya mengatasi hambatan dalam pelaksanaan prinsip kehati-hatian melalui aplikasi “SIDAK Debitur” dalam upaya mencegah resiko kredit macet di PT. BPR Delta Artha Kencana di Kecamatan Pakisaji, Kabupaten Malang? Pada penelitian ini penulis menggunakan metode yuridis empiris dengan pendekatan yuridis sosiologis. Teknik memperoleh data dilakukan melalui wawancara, dokumentasi, dan studi kepustakaan (library research). Data dianalisis melalui melalui teknik analisis deskriptif kualitatif. Dari hasil penelitian lapangan yang telah dilakukan oleh penulis, ditemukan hasil sebagai berikut: (1) Penerapan prinsip kehati-hatian melalui aplikasi SIDAK Debitur sudah dilaksanakan, tetapi dasar hukum yang mengatur tentang prinsip kehati-katian melalui aplikasi terebut masih belum jelas. (2) Aplikasi SIDAK Debitur tergolong sebagai aplikasi yang masih baru, sehingga hanya beberapa BPR saja yang telah menggunakan aplikasi tersebut. (3) Upaya mengatasi hambatan yuridis PT BPR Delta Artha Kencana dapat dilakukan melalui pemahaman hukum terkait dengan pelaksanaan prinsip kehati-hatian dalam kredit menurut Pasal 4 ayat (2) POJK Nomor 18/POJK.03/2017, sedangkan upaya mengatasi hambatan non-yuridis dilakukan dengan sosialisasi secara merata dan menyeluruh kepada seluruh staf, karyawan, dan masyarakat yang menjadi nasabah di BPR tersebut.

English Abstract

The writer discusses the implementation of the Prudential Principle through the SIDAK (Sistem Informasi Data Analisis Karakter) Debitur application at PT. BPR Delta Artha Kencana. SIDAK Debitur application is an application that analyzes the character of prospective debtors to determine whether the prospective debtor is eligible to become a debtor. This application can be the solution to the occurrence of non-performing loan. However, in implementing the SIDAK Debitur application, there were several obstacles encountered in terms of juridical and non-juridical. Based on statement above, two problem statements were proposed: (1) How to implement the prudential principle through “SIDAK Debitur” application in order to prevent non-performing loan at PT. BPR Delta Altha Kencana in Pakisaji, Malang? (2) What are the juridical and non-juridical obstacles, and the efforts to prevent the risk in the implementation of prudential principle through “SIDAK Debitur” application at PT. BPR Delta Artha Kencana in Pakisaji, Malang? In this research, the writer used the empirical juridical method with a sociological juridical approach. The technique of obtaining data is done through interviews, documentations, and library research. Data were analyzed through qualitative descriptive analysis technique. From the field research conducted by the writer, the following results were found: (1) The implementation of prudential principle through SIDAK Debitur application has been done. However, the legal basis governing the prudential principle through the application is still unclear. (2) The SIDAK Debitur application is classified as a new application, so only a few of Rural Banks (BPR) have used the application. (3) The efforts to prevent the juridical obstacles of PT BPR Delta Artha Kencana could be done through legal understanding related to the implementation of prudential principle in credit according to Article 4 Section (2) POJK Number 18/POJK.03/2017, while efforts to prevent the non-juridical obstacles could be done by disseminating evenly and thoroughly to all staff, employees, and the public who are the customers in the BPR.
