Abstract
Penelitian ini secara khusus meneliti hukum partisipasi dalam kasus aborsi. Dalam penelitian ini mengacu pada keputusan No. 124 PID.SUS I 2014 PN.LIW. Ada beberapa pengaturan untuk kejahatan aborsi, yaitu pasal 346-349 KUHP (KUHP) dan UU No. 23 tahun 1992 tentang "Kesehatan" sementara partisipasi pidana diatur dalam Pasal 55 KUHP. Penulis menganggap bahwa ada ketidakjelasan hukum yang mengatur dimasukkannya aborsi di mana unsur-unsur pelanggaran berpartisipasi dalam kejahatan aborsi belum jelas dijelaskan dalam hukum positif.Jenis penelitian hukum yang digunakan adalah yuridis normatif, yang biasa disebut penelitian literatur atau studi dokumen. Disebut penelitian yuridis normatif hukum karena penelitian ini dilakukan atau dimaksudkan hanya pada aturan tertulis atau bahan hukum lainnya. Sedangkan yang disebut sebagai penelitian kepustakaan karena dalam penelitian ini lebih banyak dilakukan pada materi-materi yang bersifat sekunder di perpustakaan. Untuk mendukung studi yuridis normatif ini. Bahan hukum primer diperoleh dengan mengumpulkan undang-undang inventarisasi dan peraturan yang berlaku dan disesuaikan dengan pokok bahasan yang diteliti. Bahan hukum tersier diperoleh dengan melakukan inventarisasi buku-buku pustaka, dokumen, artikel, dan berbagai materi yang telah diperoleh, direkam dan kemudian dipelajari berdasarkan relevansi mereka dengan mata pelajaran yang diteliti yang kemudian dilakukan penilaian secara keseluruhan Bahan hukum yang diperoleh dalam penelitian ini akan disajikan dalam bentuk uraian yang disusun secara sistematis mengikuti alur diskusi sistematis.
English Abstract
This research specifically examines the law of participation in abortion case. In this study refers to the decision No. 124 PID.SUS I 2014 PN.LIW. There are several arrangements for abortion crime, namely articles 346-349 of the Criminal Code (KUHP) and Act No. 23 of 1992 about "Health" while the criminal participation is regulated in Article 55 of the Criminal Code. The author considers that there is a legal obscurity that regulates the inclusion of abortion where the elements of the offense participate in the crime of abortion has not been clearly explained in the positive law. The type of legal research used is normative juridical, commonly referred to as literature research or document studies. Called legal juridical normative research because this research is conducted or intended only on the rules written or other legal materials. While referred to as literature research because in this study more done on materials that are secondary in the library. To support this normative juridical study. Primary legal material is obtained by collecting inventory laws and regulations that apply and tailored to the subject matter of the studied. Tertiary legal material is obtained by conducting an inventory of literature books, documents, articles, and various materials that have been obtained, recorded and then studied on the basis of their relevance to the subject matter studied which then carried out the assessment as a whole. The legal material obtained in this study will be presented in the form of descriptions arranged systematically following the flow of systematic discussion.
